Social media giveaways take place on your Facebook, Instagram or Twitter profile, while online contests have their own unique microsite.<\/p>\n\n\n\n<p>And in Italy, the laws about giveaways and contests are very different. Make sure you read the correct set of rules for your marketing campaign.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to run a social media giveaway in Italy<\/h2>\n\n\n\n<p>Italian law is very clear: if you want to run a giveaway on social media, it has to be in partnership with the social network. But Facebook, Twitter and Instagram all refuse to be officially associated with promotions. <\/p>\n\n\n\n<p>So you&#8217;ll need to include a <strong>disclaimer<\/strong> in your giveaway post. Explain that the promotion is not officially associated with the social network. In the <strong>terms&nbsp;and&nbsp;conditions<\/strong>, you have to state that the giveaway is only open to people who were registered on the social network before the promotion started.<\/p>\n\n\n\n<p>Whenever you run a social media giveaway, you have to collect participants&#8217; data to choose a winner. But <strong>Italy\u00a0has\u00a0very\u00a0strict\u00a0data\u00a0rules<\/strong>. If you collect data, you have to host it on an Italian server&#8230; and that&#8217;s not possible for social media data.<\/p>\n\n\n\n<p>So, is it possible to run social media giveaways in Italy? Yes! But there&#8217;s only one exception to the laws about data hosting. To run a legal social media giveaway in Italy, the <strong>prize must be worth<\/strong> <strong>less&nbsp;than&nbsp;1\u20ac (VAT included).<\/strong><\/p>\n\n\n\n<p>And finally: what if you want to run a social media giveaway based in another country? You can include Italian customers &#8211; with two conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There is no purchase required to enter the contest.<\/li>\n\n\n\n<li>No communication takes place on Italian territory.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>If you want to share a prize that&#8217;s worth more than 1\u20ac, you have to run an online contest with an entry form. Read on to learn how.<\/p>\n<\/blockquote>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to run an online contest in Italy<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Before the contest begins<\/h3>\n\n\n\n<p>According to Italian law, contests and sweepstakes in Italy are subject to a series of regulations. Simply drawing up the&nbsp;terms and conditions&nbsp;is not enough. You also have to comply with the following procedures:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Terms and conditions.<\/strong> There are no models for the drawing up of terms and conditions. However, the terms and conditions must include <strong>all the information stipulated by regulations<\/strong>.<\/li>\n\n\n\n<li><strong>Guarantee the prize value.<\/strong> Choose a guarantor or make a deposit in the Bank of Italy, to show that you are offering a genuine prize. <\/li>\n\n\n\n<li><strong>Official form.<\/strong> Fill in a complex official form with information about the promotion.<\/li>\n<\/ul>\n\n\n\n<p>You must&nbsp;complete the form <strong>at least 15 days before<\/strong> the promotion starts. You can submit it online to the Ministry for Economic Development (<a rel=\"noreferrer noopener\" aria-label=\"Ministero del Sviluppo Economico (opens in a new tab)\" href=\"https:\/\/www.mise.gov.it\/index.php\/it\/\" target=\"_blank\">Ministero del Sviluppo Economico<\/a>). <\/p>\n\n\n\n<p>The document should be sent by a <strong>physical and legal Italian resident<\/strong> with an authorized digital signature. If you want to run a promotion in Italy, you must either be Italian or have a tax representative in Italy.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">During the contest<\/h3>\n\n\n\n<p>According to Italian law, contests and sweepstakes in Italy are subject to a series of regulations. Simply drawing up the&nbsp;terms and conditions&nbsp;is not enough. You also have to comply with the following procedures:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Contest app.<\/strong> You must use contest software which is secure and fair. The contest server should be located in Italian territory. If the goods or services are VAT-free, then you have to apply a substitute tax of 20% of the purchase value. But the tax rules change again if your contest is aimed at non-consumers!<\/li>\n\n\n\n<li><strong>Manage the winners.<\/strong> This is one of the most important phases of your contest, so it requires care and precision. Notify winners according to the terms and conditions, and provide exact instructions to claim prizes.<\/li>\n\n\n\n<li><strong>Deliver the prizes.<\/strong> According to Italian law, prizes must be awarded within 180 days, and the delivery should be certified and verifiable. If you can&#8217;t deliver the prize, or there is no winner, then you should donate the prize to a non-profit organization.
