What Should the Brand and Influencer Agree on Before Publishing?

Planning should start before creating the Reel or writing the giveaway caption. The brand and content creator should agree on the objective, entry mechanic, prize, and division of responsibilities before the campaign goes live.

Define the Goal and Success Metrics

An influencer giveaway can support different objectives, such as:

Define Responsibilities Before Launch

The collaboration agreement should clearly establish:

  • Who is the legal organizer
  • Who creates and publishes the content
  • Who reviews and approves the post
  • Who provides and delivers the prize
  • Who drafts and hosts the Terms and Conditions
  • Who responds to participant questions
  • Who collects the entries
  • Who carries out the random winner selection
  • Who contacts the winners
  • Who manages any winner replacement
  • Who is responsible for any tax obligations related to the prize

The parties should also agree on content usage rights, including how long the brand can use the content, on which channels, in which territories, and whether it can be used in paid advertising.

Who Should Publish the Influencer Giveaway?

The giveaway can be published from the influencer’s account, the brand’s account, or both. The best option depends on where you want the interaction to happen and who needs to retain control of the content.

The Influencer Publishes and Asks Participants to Follow the Brand

Instagram Collabs is not essential. The creator can publish the giveaway on their own account and present the brand as the sponsor or as one of the accounts participants need to follow.

This setup concentrates the interaction on the influencer’s profile and takes full advantage of the creator’s ability to mobilize their community. The brand does not need to publish the same content on its own feed, but it still needs a reliable way to collect the comments and manage the winner selection.

The Brand Publishes and the Influencer Drives Traffic

Another option is to publish the giveaway on the brand’s account and use the influencer primarily as a distribution channel.

The creator can promote the giveaway through Stories, Reels, or other content and direct their audience to the brand’s post to enter.

What Can You Ask Participants to Do in an Influencer Giveaway?

The entry mechanic should be easy to understand and aligned with the campaign objective. The more requirements you add, the harder the giveaway becomes to explain and the more difficult it is to verify that every participant has completed them correctly.

Comment on the Post

Comments are the simplest participation method to collect through Meta’s official API.
You can ask participants to leave an open-ended response or answer a question related to the product, for example:

  • Which recipe, destination, or activity they prefer
  • Which product they would choose
  • How they would use the prize
  • Who they would share an experience with
  • Which feature matters most to them

A question connected to the content can generate a more relevant conversation than simply asking participants to leave a generic word or emoji.

Mention Other Users

You can also ask participants to mention one or more people in the comments. Mentions can help expose the giveaway to additional users and extend its reach.

The rules should clearly state how many people must be mentioned and whether additional comments generate extra entries. However, Instagram does not allow this requirement to be verified automatically at scale. For that reason, we recommend checking whether the selected winner and alternates follow the required accounts manually before confirming the final result.

Share the Giveaway to Stories

We do not recommend requiring every participant to share the giveaway post to Stories. This action cannot be verified automatically and reliably for all participants, and Stories disappear after 24 hours. It can instead be used as an optional action, provided the Terms and Conditions clearly explain how the share will be validated and how any additional entry will be awarded.

How Do You Collect Entries When the Influencer Publishes the Giveaway?

When the giveaway post belongs to an influencer, the brand or agency should not need access to the creator’s password or general account credentials. Legal Requirements and Compliance for Influencer Giveaways

An influencer giveaway is a promotional campaign, and when there is compensation or a commercial relationship between the brand and creator, that relationship should be clearly disclosed.

Compliance protects the brand, the influencer, and participants, while also showing that the collaboration has been planned and managed professionally.

Disclose the Commercial Relationship

The creator should clearly indicate when the content is part of a commercial collaboration. The disclosure should be easy for the audience to see and understand.

When appropriate, brands and creators should also use Instagram’s available paid partnership or branded content tools in addition to the required disclosure in the content itself.

The applicable requirements vary by country and industry. Promotions involving areas such as financial products, alcohol, gambling, health, or minors may be subject to additional restrictions or obligations.

Publish Giveaway Terms and Conditions

The brand and influencer should also publish Terms and Conditions that clearly explain the giveaway rules. At a minimum, they should include:

  • How and when the winner selection will take place

How Do You Select Winners Fairly and Transparently?

Once the participation period ends, the organizer needs to import all valid entries, apply the published giveaway conditions, and select the winner or winners using a verifiable random process.
